  the kaleidoscope was a really cool venue. i read that it was an old dance hall/nightclub from the 20's or 30's that was built in a circle. the stage was the center with a dance floor around it and elevated area for tables and seating beyond that. the "hallway" was outside of that. and here's the cool part - they all rotated in opposite directions from each level. so the whole thing slowly around in a confusing fashion and added to the delerium of the drugs. to top it all off, there was also a spinning circle or two of natural gas flame jets that also spun counter to the rest. when it was all on i guess it was truly amazing. then add the early airplane and the early dead and a few thousand grams of owelsly acid and, well.... you get the picture.

  sub genius stole them from roth (whom rob't worked for) as far as i know.

that, however, didn't stop the sub genius dudes from sueing a major corporation (i was dragged in as a source of info on them) for using images from their "book". cthey had NO rights to the copyrights of the stuff they used, but they still sued a corporation. it was settled out of court. real guts and more than a little crazy.

DON'T LIFT FROM THE SUB GENIUS FOUNDATION! they take this stuff as seriously as 'religion'. no joke!

  upon studying these skulls, i reognize at least two as robert williams drawn skulls that he did for ed roth, who subsequently sold the copyrights to japan (sony, i believe). as far as i know the rights are in contention and are not enforced, but may be someday. so, i think it's really dangerous to just grab stuff out of craphound at random. be VERY careful when you use clip art. have deniability built in. be able to back up yer bullshit. trust me on this.

well, sean (after consulting with a lwyer) decided to not 'officially' call it a clip art book, because it does open the door to legal drama that COULD happen (but likely won't ever. it's now officially called "a picture book for discussion and activity", which is undoubtedly a safe phrase, as well as funny. ya see, craphound is a periodical, a magazine ('zine). that means it is protected from a lot of legalities under the first amendement of the constitution as free speech and freedom of the press. freedom of the press allows a wider range of image use under the first amendement unmbrella. it it were a book (which is a product and not covered under the first amendment), or a t-shirt or a poster, it would not be protected as a newspaper or periodical would be. so, it is in a rather unique position under the law.

sean uses this 'soapbox' as a place to question and challenge the fairness of contemporary copyright and trademark laws and to also promote the (as of this point) unproven (in a court of law) legal concept of "fair use". it is an idea he firmly believes in. further, i think theat he thinks ALL copyrights law is inherently unfair and should be eliminated. however, that would also include your copyrights. so, there really is no either/or position to take here, only shades of gray.

the bottom line is that sean is free to publish whatever the fuck he wants in his zine and it's ok. however, if you take one of his images and use it directly on something unprotected (like a poster or a tshirt or a cd cover), you run the risk of being nailed by whomever holds the copyright to that image. it could be me or you or a multinational coproration. you just don't know.

a poster like this is a wonderful funny, even brilliant thing (the ultimate 'skull' poster. it's almost to the point of being a joke). but, it also walks a very fine and undetermined line through copyrights. it's very expensive to get sued. it quickly becomes whomever has the most money to pursue the other (aka - deep pockets) that will determine who will eventually win. the game is played to break the other financially. if it were you and i having a dispute about copyright, we'd come to some personal agreement and it would be over. it you were up against a big corporation, those lawyers have to justify their hourlies and will drag it out forever to make money for themselves. you will be destroyed by them. it's like a steamroller.

so, watch it out there.
