    The only difference is that one source is broadcast on TV, the other is a building on Lake St. Nothing false about that equivalence, really.

    One is a copyrighted character owned by a major corporation, the other is a building visible from public space.

    That could have been a landmark case for fair use but from what I understand he messed around with evidence and tainted the case.
