Anybody care to weigh in on the question of what constitutes "Fair Use" of found/aquired images versus "Hey you fuck - that's my mom's graduation picture!" as far as the old pan & scan / photocopy image manipulation etc.? Where is the "intellectual property" line?

There is none. If it's okay to swipe one thing, it's fair to swipe it all. Like that Tad cover with the Polaroid they found at a garage sale of some Doug Henning lookalike squeezing some chick's tit - they got sued over it because that chick became a christian, but if she didn't want people to see that, she shouldn't have been in the picture.

no there is a huge line-
    copyrighted should not be used-period!-
    for example-
in the past people here were repremanded when they stole an image from another artist-

    which was warranted-

you wouldnt want your design ripped off and used-

the truth is that people seem not to care-
    they rip-
they say its ok-its rock n roll baby-

    but in the end-
alot of swipers would not have a job-

Copyrights aren't really paid attention to in gig poster art. I've seen more posters sampling DC and Marvel comics (I think Frank has one using a Fantastic Four pic - I don't remember - Goad pointed it out to me). If copyrights aren't sacred, nothing is. I'm not saying it's right, but it's certainly how it's done.

So, if it's presented as "hommage" or kitsch or whatever it's OK, or least not actionable?

    yes-
you CAN get away with it-
but it goes across the line-
heck a poster image was stolen from an artist and reused here-
    and everyone was against it-
if its copyrighted-you can get away with it-
but why not just CREATE your own?-

    why chance getting slammed?-
i see alot of great rip jobs here-
    i love them-
i cringe if lawyers saw em-

I'm thinking more along the lines of using old advertising or found images, not so much plagiarizing another artists work. There were some interesting thoughts on that in another thread recently.

So, scanning the 1962 Dixie Panthers high school year book or utilizing an old image or photo from a magazine isn't likely to set off alarm bells?

at the end of the day, when youve finished printing up your posters with the imagry stolen from some other guys, do you feel good about yourself as an artist? i think thats what keeps me away from stealing imagry the most. like how is stealing images gonna further my artistic talent? not a whole lot probably. i once took a magazine article about those remote controlled rats and used the rat as a model for a rat i made on the poster, this one asshole in the studio said it was blatant theft and my professer said it wasnt, even if i had traced the image. so i dunno... i dont steal shit because its not gonna make me any better and we should ALL try to push ourselves to make the best art we can ya know, otherwise shit around here will get a lot more boring, with like only teddy bears and fuckin cartoon and comic character ripoffs (although i like those posters, i dont want every one to be like that)

If the person who's photo is used for an Anal Cunt poster sees it and freaks out, you might find you have a minor problem, but once again if copyrights don't matter, uncopyrighted material is certainly not sacred. Honestly, if you don't render your own images and rely on "found art" as a basis for your work, yearbook photos and the like are probably less likely to come back and bite you on the ass.
