Default Legal issue...

well not quite yet... but maybe you guys/gals can give me advice.

I get an email from a guy who runs an embroidery shop in the states, says he browsed through my photos and posters and likes this one image and sends me this email...

"I was gonna get your permission to digitize and sew up a few of the Motor/skull design for hats. If thats Cool, send me your address, Ill send you a few. I really think that design is cool."

So this guy basically has said "I want to bootleg your art, but I will send you a hat". Now... first of all it sounds like this guy is going to do it anyway if he hasn't already... I want to a way to tell him no that will pretty much scare the bejeezus out of him so he won't do it.

any suggestions?

tell them you're an artist and thats how you make your living. if he wants to license it then you can discuss from there.

sounds like this guy is 'new' and needs to be set straight.

hats dont pay the rent.

Just tell him that you own all rights to the artwork, and you'd be happy to sell him merchandising rights to that artwork for a negotiated fee prior to any work being done.

Warmly congratulate him on his good taste. Thank him for contacting you.
Tell him you are a professional designer, with many cients in Canada and the USA - if he wishes to license the design, you can talk about an outright purchase, or a royalty.

Add that if he proceeds to digitalize and produce your image or any dirivative on caps or other material without an agreement in place, he will be liable for prosecution and damages for copyright infringement. Copies of his email stating his intention to use the design without proper permission from the copyright holder, plus your reply, have been forwarded to your lawyer. You look forward to his reply.

Either that or tell him you want 200 caps straight up - then you can finaly get a booth at SXSW instead of staggering around bothering people all day...
