    Default Will i get in trouble?

    Ok. I'm working on an album right now and the musician wants me to use existing photographs of typewriters/calculators that he found. He already contacted photographer and got the permission to use them. My concern is this: even with the photographer's permission to use his photos, can one of us still get in trouble because the photographer took pictures of the products without the permission of the manufacturer? The typewriters and calculators are old, some of them are antiques. It would be like me hiring a photographer to take a picture of a Coca Cola can and use it on an album cover.

    I know this might sound a little far fetched, but I just want to be well
    informed on this and be 100% sure the musician and I won't get in trouble.

    no, if the photographer gave you permission to use them, and he took them, you are fine.

    I know when we shoot our bikes at work, we own the products, but not the photographs.

    If there is a trademarked product in the image the manufacturer can always sue if they don't like the presentation of the trademark.

    Emerson recently sued NBC for using one of their garbage disposals in an episode of Heroes since the trademark was identifiable in the episode. Emerson claimed the garbage disposal was presented in an unfavorable light.

    In video work for instance, you'll note that trademarked items other than that of the client are never to be displayed and model releases must accompany any sort of private property, person, item, etc.

    this really made me laugh for some reason. what the hell were they doing with it in the episode that made it so unfavorable?
