Here's how my agency agreement reads:

The Client will pay Shadowland Studios a cancellation fee if the assignment is cancelled after the proposal has been approved, for reasons beyond Shadowland Studios control.

The Client will pay Shadowland Studios a rejection fee if the preliminary or finished art is found not to be reasonably satisfactory and the project is terminated.

    The fees are as follows:

    * If cancellation or rejection occurs prior to the completion of the concept stage, the Client will pay 25% of the agreed project fee.

    * If cancellation or rejection occurs after the completion of preliminary work and prior to the completion of finished art, the Client will pay 50% of the agreed upon project fee.

    * If cancellation or rejection occurs after the completion of finished art, the Client will pay 100 % of the agreed upon project fee.

    * All out of pocket and third party fees will be paid in full.

    * Upon payment in full of the cancellation fee, all agreed upon reproduction rights will be transferred to the Client for artwork completed up to the point of cancellation.

    * In the event of rejection, the Client has chosen not to obtain the rights to the use of any of the artwork created for this project. Therefore, all rights remain the property of Shadowland Studios.
