    Default The Arminski case

    The nightmare scenario for all poster artists is the Arminski case. Arminski was sued for producing Phish and a Dave Matthews posters, even though he was contracted to produce them by the promoter.

    The case settled before trial and although I looked long and hard I could find the details. In his article Jagmo seems to be saying that Arminski had a BUNCH of solid defenses.

    Anyone know the details to the settlement? I did find a article written before the settlement that said they were dropping the $ demand against him.

    i don't think it's a nightmare scenario for all poster artists at all.

    Just don't do posters for shitty bands with giant egos and unaccounted greed.

    That makes absolutely no sense.
    Arminski did not "DO" posters for Dave Matthews and Phish.
    He did them for a promoter, which doesn't give him any rights to the Dave or Phish "brands"...

    Those bands (and a few others that everyone hates) do so much to support poster art. They should be respected.

    except for phish, they just play suck ass music and didn;t their bass player try and fuck some underage kid?

    Fuck that, Arminski was just doing his job. A cease and desist I can understand, but a lawsuit seems kinda harsh under the circumstances.

    I dont know the specifics of the case, i know that phish has given cease and desist orders to other artists, and some bands have contacted the artists directcly asking that they stop selling posters. So maybe there is more than meets the eye to this case.

    Honestly, i think its kinda funny that people on this site will flip out when they see their work being used be other artists with out their permission. But when it comes to the instance when a band gets upset when their name etc is being used for profit etc people dont get it.

    I totally get it and agree 100%. I guess I'd just like to think that the artists and bands could work it out together without bringing down the hammer on an artist who is trying to make a buck on what he believes he's been commissioned to do. I mean they WERE used to promote the show, it's not quite the same as someone intentionally printing bootleg merch.
