Just to split hairs, it was actually Phish's management, not the band, that went after the Arminski (wasn't EMEK residually involved in this too for his Phish poster?), and I believe Dave Matthew's management filed suit first. Arminski did the '94 poster w/o a problem, it wasn't until the '95 ones that they sued. A few years back Phish's management tried to sue a clothing company selling shirts with Phish song names, or more specifically, commonly used setlist shorthand acronyms for Phish songs on them. They had to drop the case, part of the manufacturers defense were pictures that featured members of Phish wearing his shirts. Hilarious.
In a grateful dead book they talked about how when Ben & Jerry's first produced Cherry Garcia they didn't ask permission, Jerry didn't want to sue, but the bands lawyers pointed out that if they didn't file a suit then there would be more products out there with his name and/or likeness used, so they filed suit, but then granted retroactive permission or something and dropped it (probably sharing in profits though).
