sometimes you stumble upon real cool pictures you'd like to use in your art. you modify it with some filters and make a poster out of it.
the original photographer sees it. what can he do?

Yep - in court - the question is whether or not you made a profit off of it. Why Kazaa and other shareware application are under fire - but can't do anything to the hoarding downloader.

I think you're ok if the picture was printed in 1923 or earlier.
