i'm trying to get out of the "found art" mentality. i like the look of a lot of old pics, etc...but when it comes right down to it, you're stealing... and if that piece is reproduced and sold or published, you are putting yourself at risk.
however, if you're just making 11x17 xerox flyers for a punk show, i wouldn't sweat it...
but-if you make money off of it, look out.
Yep - in court - the question is whether or not you made a profit off of it. Why Kazaa and other shareware application are under fire - but can't do anything to the hoarding downloader.
I think you're ok if the picture was printed in 1923 or earlier.
