Default The Digital Millenium Copyright Act of 1998

So i thought this may be of interest to artists in general.... while doing a little research on Cease & Desists, I spoke with an attorney who shared this with me....

The DMCA is a piece of work that

·******** In general, limits Internet service providers from copyright infringement liability for simply transmitting information over the Internet.

·******** Service providers, however, are expected to remove material from users' web sites that appears to constitute copyright infringement.
Many ISPs now will remove copyright infringing material that has been published on the internet at the request of the copyright holder. No interaction with the person or entity who is committing the copyright infringement is necessary in most instances.

Anyway, if you would like to read more about it, google Digital Millenium Copyright Act 1998 - there is plenty of info out there about it. This is the principal that Ebay uses to run their VeRO program.

Exactly... and the WILL side with the person complaining to avoid legal hassles. Their attitude is better to yank it then to have litigation

Yep .. its real easy to do. I've had to do it before (since I also run a webhosting company). If you want your posters removed from .. lets say .. a website that is charging people to view them .. all you have to do is contact their host or server provider.

After a few complaints, they will completely pull the plug.

Just as an example, here is Earthlink's policy on this: http://www.earthlink.net/about/policies/dmca/

    Amazingly simple.

Also, if you ever need the contact information for a web site, or need to know who their ISP is, do a whois.com lookup on the URL.

    Easy peasy.

    Yes, its VERY simple

One thing I totally recommend EVERY artist whose art is being auctioned on Ebay, is to sign up with the Ebay VERO program... It will make pulling bootlegs of your art from Ebay very easy and painless.
