    Default Clarification on copyright

    Ok I’ve been reading the bjillion other posts on the subject but gave up after about 15 pages lol
    I’m just using this as an example to clear things up in my own head so I don’t waste a lot of time and money and end up in court ops:

    If I wanted to produce gig poster 'style' art prints/t-shirts and sell them at a music festival as a souvenir rather than for advertising the actual festival/bands

    For example could I -

    1 Use the name and date of the festival as long as no copyrighted logo's are used etc
    2 Use bands names, again not using anyone else’s logo's or copyrighted material? Or are the band names themselves copyright protected ?

    Merchandisers pay money to artists/labels for the rights to produce merchandise bearing a band's name or image.

    If you do not have written permission to do this, you are a bootlegger.

    Basically, its something that many people do... and get away with... but is actually illegal, and is something that will piss alot of people off (Other then your customers). Its an easy way to make some money... but just as easy to get on quite a few people's shit list...

    Just for the sake of terminology, names of things (e.g. festivals, venues, bands) are generally protected by trademark, not copyright. Images, on the other hand, can be protected under copyright, trademark, or both.

    I know some guys who make bootlegged emo tshirts and sell the crap out them on ebay. Not punk at all.

    Hi everyone, this is an amazing site and exactly what I have been searching for.
    My question is what kind of prices can be expected to produce merchandise for a group/band or artist?
    Any kinda idea would be great.
    Now i'm off to check out the poster artwork.
