    Default To draw or not to draw?

    Hope this works. This place just doesn't like me. Seems like I can never stay logged in.

    Guess I'll type it again!?!

    Someone called me up to draw a t-shirt design. I was jazzed. It seemed like a fun little illustrated concept.
    One big massive goomba destroying the others symbols, fanbase, and support. A few national symbols thrown in also.

    It all seemed like a blast to draw until I realised I'd be violating ©'s and trademarks.

    It's for a group of freinds (not mine they're willing to pay).

    I think it might have been ok and I wouldn't have given it a second thought, but the guy said, "oh one of the guys we were wiht knows this player who might buy some of the shirts."

    I was thinking about doing the drawing without the symbols and have them add that in, but what's the point?

    ?ANY THOUGHTS?

    Does it fall under Parody? You can get away with a lot with the parody thing.

    Or just get paid up front for the artwork. You're the last guy who's gonna get sued.

    What's the diff between parody and libel?

    Just the legal struggle?!?

    If nobody comes after ya it's parody.
    If someone does it's trouble.

    Hey Richie I think the guy might need a printer?

    The difference between parody and libel...hmmm...pretty fine line. I'm no lawyer.

    Yup. The lawsuits seem to go down the line.
    Store Carrying the Finished Product>Guy Selling the Finished Product>Printer Guy got the Product From>Artist.

    As the artist you can pull off playing off that you didn't know what the guy was using the drawing for. He commisioned you to do a drawing. You did it and you sold the rights to that drawing to him. Your nearly in the clear, unless you get a royalty deal and then you're still in the chain.

    depends big al. who does the 'victim' want to go after. i've been privy to the whole 360 ( me/client/printer) and it really depends on who the 'plantiff' want's blood from.
