uhhh depends... i am not a laywer but basically if you take a picture you own the copyright the very moment you snap that picture... however an exception is when you are doing work-for-hire which usually menas that you transfered the copyright to the client and in which case they usually can do whatever they want with that picture...

    HELL YES!

This just happend to me. I did art for a shirt for this band, I told them I would sell the art to them for 75 bucks, with the agrement they only use it for shirts and they get the shirts printed thru me, if they wanted the art to use for whatever they want then it would be $500.00 and they can print the shirts thru whoever they choose.

I just found out they took my lowres mock up to another shirt printer, got the art remade for free and then got the shirts printed at that same shop.

    SO BUNK.

These dudes do not live anywhere near me other wise i'd have my "biker" friends showing up at his door.

You Should... but it really depends. Did they ask you to take their picture in the first place? how did they get your images? did they already pay you for the "photoshoot"(?).

It sounds like these are just buddies of yours that you took some pics of then you gave them prints and now they are using it for printed shit. well if that's the case then you should get some money - but more than likely you won't.

Should cover your ass from the get-go

if you didnt have something in writing before hand you may be screwed. i have a part in my contract that basically says the art ive done can only be used for what we agree on in advance in writing.

This is the right way to cover your ass - but you still got screwed! fuck. that's so so wrong.

what city do they live in. we should have somebody go to a show and steal all the shirts.

Who has the negatives? Back at Kinko's they used to tell us if the customer had the negatives then that was proof enough of copyright ownership.

Probably just a misunderstanding with you and these guys though. If it truely bothers you, try calmly discussing it with them.
