As much as this is a blatant rip-off, I suspect there is a misunderstanding about the role of a Creative Director and a Designer. A creative director at a large agency doesn't "design" anything. At an agency, a CD is a management and client facing position. It is overwhelming likely that the CD himself never touched this design file once. They gave direction to the creative department, managed a team, internally they chose which concepts will go forward, and then presided over the client presentation of the work, where the client would have chosen their preferred direction, probably from 2 or 3 options. As the member of the management team responsible for creative, the CD would be held responsible for making a statement to the press. He probably asked the designed if he ripped it off. Clip art was probably the reply. Then he saw the original art, black-listed the freelancer, and gave the retraction.

and the firm will almost certainly be fired as the "No Labels" agency.
