    Default Fanshot band photos

    I recently was contacted by a friend to inquire about purchasing some photos of a Legendary punk band…

    I met with him and checked out the photos and sure enough they are seemingly the first live photos of this band. Supposedly, from their first gig.

    As the story goes, the drummer from the bands brother took these(trying to sell them to me because he's fallen on hardtimes).

    Im a HUGE fan of this band so I’d like to have something like this…To get to the root of why I posted this…Where do I stand to reproduce this image?

    I was considering doing a silk screened poster of at least one of these images to poss sell as an artprint

    I’d like everyones input…good, bad, indifferent.

    If I purchase these photos, can I legally reproduce the image?

    Who owns this image(Band, photog, purchaser)?

    Should this be outlined in writing prior to any type of purchase?

    I don’t know that Ive ever seen anything like this addressed on here..

    Artists usually retain all rights to the image unless otherwise specified/paid for. So if you plan on doing this you need to ask how much for all rights to the image. There may also be band legalities you'll need to find out about as well. I know photography can be a slippery slope on image licensing.

    well, to start, buying the photos (as objects) is different from buying the rights to reproduce them.
    most of the time we never fish!

    are you also getting the negatives? or just prints?

    Im not sure.....this needs to be discussed more in depth with the guy who owns/took them....Im meeting with him tonight which is why I asked.

    It was proposed to me about buying them.....to what degree would be discussed tonight.....I did consider just creating the image to be printed and either be paid in total or work out some kind of split.

    His brother still recieves and lives on royalties from the band....so I imagine he'd have some input on the photo right?

    Last thing I'd want is a lawsuit..Thanks guys.

    From my understanding of photography you would need signed releases from those in the photo to legally reproduce them. It's worth a shot to ask if the guy who shot it has signed releases from the band.
