    Default The Resale Right

I'm interested in hearing your opinions on this.

i'm not excpetionally educated on this issue, admittedly. i also admit to having 6 browser windows open at the moment and am in the middle of a complex client email, hence my forum break, just to give my state of mind in case i am missing something terribly relevant and in opposition to the initial thoughts that i have.

which are that i am not opposed to that idea. implementing it must be a bitch, and i wonder what types of art are included. i've certainly sold stuff in european galleries and never got the extra dollar (if that) which would be my cut. i am curious how that law is applied and to whom, and why.

that type animation is close to perfection, for sure. wow.

I saw this at motionographerdotcom a while back.

I had similar questions when I saw it. This was what the animator said:
According to Pierre, “The ADAGP is the French collective rights management society in the field of the visual arts (painting, sculpture, photography, multimedia, etc.). It represents almost 80,000 artists. They asked for a film that explains what the resale right is.”

I was under the impression that when someone's work, say Damien Hirst, sells at auction, at say Sotheby's, regardless if it's just between dealers and collectors, every sale and transfer reserves a cut for the artist. A piece of work can trade often enough to increase the value of the work at a very steep rate until it levels at a maximum price, at which point we could presume the artist is entitled to a portion of the true value of a work. That's why this kind of thing is probably in place to avoid earning only a small portion of an initial sale. I doubt to expect most of any of us to end up having our work's ownership observed during every transaction at such large sums of money, but if you make it to that level it'd be smart to get a cut every chance you can. Fuckin art world and the money behind it...
